Deed of Trust (All deed of trust should include the purpose of the deed in the deed of trust application)

a) Mortgage document in duplicate

b) Consent from relevant authority whichever is applicable

c) Valid Tax identification number (TIN) of all parties

d) Lodgment Fees $1.10 (VIP)

Transfer by Mortgagee Sale

  • Duplicate title is required
  • A statutory declaration by the mortgagee must be furnished setting out the facts relating the exercise of power of sale and default up to the date of transfer
  • Registered dealing number of the mortgage that is subject to sale must be stated.
  • Duplicate mortgage subject of the sale is required
  • Consent whether ITLTB lease or Lands department lease.
  • Full name, address and occupation of the mortgagee and registered proprietor must be stated as shown on the title
  • Type of title, title number, land description and area must be stated, newspaper article, demand notice, affidavit of service
  • Consideration must be stated in figures and writing
  • Demand notice to be attached to the application
  • Evidence of notice placed on property (visible photographs)
  • Date of execution
  • Signatures to be witnessed by a solicitor
  • The signatures and the witnessing to be done correctly
  • Attach a Statutory declaration form (signed & witnessed by solicitor if name is different from ID)

Transmission by death

  • Transmission by death is lodged where a sole proprietor or a proprietor, holding as a tenant in common dies.
  • Original probate, letter of administration or copies certified by the issuing authority is required with any other supporting evidence.
  • Duplicate title/lease needs to be submitted in the application.
  • Full name, address and occupation of the applicant must be provided.
  • Probate – With will
  • Letters of administration ( LOA) – No will
  • “De Bonis Non” – Letters of administration of the estate of a deceased person when administration has previously been granted to someone who has himself/herself died before completing the administration of the estate. The second grant enables the administration of the estate of the deceased person to be completed.
  • Signatures of the Trustees to be witnessed by a solicitor
  • The signatures and the witnessing to be done correctly
  • Attach a Statutory declaration form (signed & witnessed by solicitor if is different from ID)
